DPP rules no charge should be laid against Floyd Green

The Office of the Director of Public Prosecutions, has ruled, that no criminal charge should be brought against minister Floyd Green, in relation to allegations, that he breached the Disaster Risk Management Act.

The DPP in a statement on Sunday, said after extensive legal research, and having consulted with her team, it was the considered opinion, that no criminal charge, should be preferred against Mr. Green, councillor Andrew Bellamy, Gabriel Hylton and Dave Powell.

The case related to an incident on September 14, at the R Hotel in New Kingston.

Following the release of a viral video showing Mr. Green, then Minister of Agriculture and Fisheries and councillor Bellamy in the company of several others at the R Hotel during a purported “no movement day”, the police commenced investigations into alleged breaches of the Disaster Risk Management Act (DRMA)

A case file was submitted to the office of the Director of Public Prosecutions on October 15, 2021 .

DPP Paula Llewellyn said she assigned a team of prosecutors led by a Deputy Director of Public Prosecutions and head of the digital evidence and cybercrimes unit to carefully assess the documentary material provided, including archive video footage from the R Hotel.

The ruling was forwarded to Assistant Commissioner of Police Anthony Mclaughlin, Deputy Commissioner of Police (DCP) Fitz Bailey and the Commissioner of Police Major Antony Anderson on Friday.

The DPP says the police requested that her office make available to the public the ruling given the high public interest in this matter.

Meantime, the DPP’s office indicated that it is it’s interpretation that, the R Hotel may be in breach of the DRMA.

The statement adds that it’s the police’s decision to initiate prosecutions, if they believe that it is appropriate to do so, having regard to their perception of the viability of the case.

Mr Green resigned as agriculture minister last year and apologized for his actions. He was brought back to the cabinet this year.
