Man freed of sexual offence charges signals intention to sue State for false imprisonment and malicious prosecution

Former banker, Darren Daley who was freed in the Home Circuit Court of five sexual offence charges yesterday (May 4) has stated his intention to sue the State for false imprisonment and malicious prosecution.

 

That’s according to his attorney, Hugh Wildman.

 

Daley had been appearing before the courts for nine years after a 15-year-old girl made a complaint against him in 2014.

 

The complainant testified that Daley sexually assaulted her twice at his house.

 

She also claimed that Daley took her to the Wyndham Hotel in New Kingston where some men paid her to be intimate with them.

 

During cross-examination, Wildman presented a newspaper article which showed that the hotel was not operating in 2014 because of a fire the year before.

 

The complainant subsequently admitted telling lies in statements she gave in 2014 and 2018 about the incident.

 

After the Crown closed its case, Wildman submitted that there were too many discrepancies for the jury to arrive at a guilty verdict.

 

The prosecution agreed and Justice Vaughn Smith directed the jury to return a verdict of not guilty.

 

Speaking with IRIE FM news, Mr Wildman noted that his client will be taking legal action against the State, in light of the complainant’s admission that untrue statements were given.
