Full Court Rules in Favour of Professor Brendan Bain in suit against UWI

The Full Court has ruled, that the right to freedom of expression was breached, when the University of the West Indies, UWI, terminated the contract of professor, Brendan Bain more than three years ago.

The court has also ordered the UWI, to pay Professor Bain 4 point 27 million dollars, as the institution failed to give him sufficient notice, about the termination of his contract.

The ruling was handed-down in the Supreme Court, Monday afternoon.

The UWI terminated Professor Bain’s contract, as head of the Caribbean HIV/AIDS regional training network, CHART, in May 2014, following concerns from local and regional gay advocacy groups, about his expert testimony, given in a Belize court case, seeking to challenge laws criminalizing buggery.

He was fired on the grounds, that his constituents had lost, confidence in him.

Monday’s ruling comes, nearly 18 months after the Full Court reserved its decision, in the 40 million dollar suit Professor Bain filed, against the University for defamation, and breach of his constitutional rights.

Following the ruling, Professor Bain said, he was relieved, that the trial is over.
