Attorney for cop freed of manslaughter to apply for client’s return to force

Oswest Senior Smith, the attorney, who represented one of the three police constables freed of manslaughter, in relation to the fatal shooting of immaculate high school student, says the next move is for his client to be reinstated in the police force.

Constable Anna-kay Bailey, and her co-accused constables Andrewain Smith, Durvin Hayles were freed by the court of appeal on Monday, in relation to the shooting death of 16-year-old Vanessa Kirkland.

In 2019, they were each sentenced to 14 years and six months’ imprisonment, for Kirkland’s death which occurred in march 2012 on Norman Lane, in Kingston.

The teen was among passengers travelling in a motorcar, to a party when the incident took place.

The constables had maintained that they were acting in self defence, as they were fired on by men in the vehicle, which prompted them to return gunfire.

On Monday, their convictions were quashed and their sentences set aside.

Oswest Senior Smith, who represented constable Bailey said after she is reinstated by the Jamaica Constabulary Force, she can decide if she wants to remain there.
