Attorney wants judge in Police Federation Chairman’s interdiction case removed

A ruling is to be made today, on a request made yesterday for Justice Carolyn Tie to recuse herself from the matter relating to interdicted chairman of the Police Federation, Corporal Rohan James.

 

Attorney-at-law Hugh Wildman, who is representing James, argued that there would be a conflict of interest, if Justice Tie dealt with the matter.

 

This as Tie represented James in a civil case, when she was a lawyer in the Attorney General’s department, while he was stationed at the Denham Town police station in Kingston.

 

King’s Counsel Peter Champagnie, who is representing the police high command, indicated that he had no objection in the disciplinary hearings being halted, pending the outcome of the judicial court’s review.

 

Champagnie however stressed that the high command was not prepared to reinstate James at this stage.

 

James is seeking a court order for his interdiction to be quashed.

 

The corporal was interdicted for comments he made, while at the funeral service for a fallen cop.

 

He had criticized the high command for not paying rank and file members their overtime monies.

 

The high command said Corporal James’ comments were disrespectful, not in keeping with JCF regulations, and had brought the organisation into disrepute.

 

James’ lawyers claim that the interdiction is a breach of his right to free speech and freedom of expression.
