Court rules that University Hospital unlawful in refusal to release body of woman to family

A Supreme Court ruling last month has made it unlawful for any hospital to hold the body of a person if relatives do not agree to the hospital’s terms.

The ruling was handed down in the case involving Nadine Evans, the mother of Carrell White.

This was revealed today (Sep 4) by human rights lobby group Jamaicans for Justice (JFJ).

The daughter died in December 2017, while an inpatient at the University Hospital of the West Indies.

Ms. Evans wanted an independent pathologist to observe the post mortem, but it’s reported that the hospital refused.

The mother was later denied access to the body of her daughter, after she refused consent to the hospital’s unsupervised post mortem.

Jamaicans for Justice took the matter to court.

JFJ Executive Director Rodje Malcolm told Irie FM News that the court judgement sets precedent on families’ rights to the bodies of their loved ones.

He said the JFJ has received similar complaints from other families and those cases will now be evaluated.
