DPP asked to determine if Corrections Commissioner is to respond to environmental breach issue

When the court case involving the Commissioner of Corrections resumes in another 3 months, it’s expected that a determination will be made as to whether or not, it will continue.

Commissioner Ina Hunter was taken to court in 2017, by the St. Catherine Health Department, in relation to a breach of the Public Health Act.

It’s reported that a liquid substance was leaking from the St. Catherine Adult Correctional Centre, onto Barrett Street.

That matter was called up in the St. Catherine Parish Court yesterday (Mar 20) before Parish Judge Natalee Brooks.

Defence lawyer Christopher Townsend argued that his client is not the person who should be before the court in relation to the breach.

Mr. Townsend says it’s the Ministry of National Security that should be held accountable for the breach, and that the ministry has the power to authorize corrective measures.

A request was made for the court clerk to write to the Director of Public Prosecutions, regarding determination of the proper respondent in the case.

The judge directed the clerk to contact the DPP and also set the matter for mention on June 19.

Mr. Townsend further stated that it’s not clear why the matter is still before the court, as the environmental problem has already been rectified by the Health Ministry, and the National Water Commission.

He says Ms. Hunter made efforts to have the breach fixed and corrective measures were in train, long before the Public Health Department took her to court.
