Several lawsuits filed against gov’t by persons who faced undue delay in their appeals

Several lawsuits have been filed against the government by persons who faced undue delay in court cases being heard, especially appeals.

And the list of applicants continues to grow with another person stating his intention earlier this week, to seek redress.

Brian Russell was freed by the Appeal Court on Monday, after the court quashed his conviction and 11-year sentence, due to the 8 year wait for his appeal to be heard.

He claimed that his fundamental rights under the constitution were violated.

Mr. Russell is one of many persons, assisted by human rights lobby groups, Jamaicans for Justice, JFJ and Stand Up for Jamaica SUFJ, as part of a collaborative project, with the public law chambers.

Attorney at law Terrence Williams is one of the lawyers representing the claimants.

He said the issue is being discussed with Russell.

Williams pointed out that, 3 other persons who suffered similar circumstances have already filed their claims, and the matters are now before the court.

Among them is Ray Morgan, whose case resulted in the UK Privy Council chastising the Jamaica courts for not hearing his appeal.

Mr. Williams said the claimants are seeking damages, as well as changes to some provisions in law that would make for a more efficient appeal process.
